Welcome to StadiumQuest.com, the premier sports and travel itinerary platform. Please carefully read these Terms of Use before using the services offered by StadiumQuest, a US registered company. By using this website (https://www.stadiumquest.com) and its associated Android and iOS apps (the “Platform”) and the features, content, applications, and services (collectively the “Service”), you (the “User(s)”) agree to be bound by these Terms of Use.

1. Acceptance of Terms

By using this Platform and/or Service in any manner, you agree to these Terms of Use in their entirety. This does include but is not limited to browsing the Platform. Any amendment to these Terms of Use will be announced before it is officially published and takes effect. If you do not agree to these original Terms of Use, you have the right to terminate the agreement and uninstall any Services and close your account on the Platform.

2. Modification of Terms

We may modify these Terms of Use at any time without prior notice. You are responsible for reviewing these terms of service periodically to ensure that you are aware of any changes. Your continued use of this app after any changes to these Terms of Use constitutes your acceptance of those changes. From time-to-time other services offered through the Platform and Services may be subject to additional terms and conditions. The use of those services is subject to those additional terms and conditions which are incorporated into these Terms of Use by this reference.

3. Account Creation, Use and Registration

In order to use this Platform, this Service, and its associated apps, you must become a User by creating an account. During the registration process, you must provide accurate and up-to-date information when creating your account. You are responsible for maintaining the confidentiality of your account login information and password. You are also responsible for all activity that occurs on your account. Failure to have accurate information (including, but not limited to username, email address and a secure password) is a breach of these Terms of Use, which can lead to termination of your StadiumQuest account.

To keep the integrity of the Platform and allow Users to enjoy the use of the Services, certain account creation activities are not allowed.

1. Creating accounts for anyone other than yourself without that person’s permission.

2. Creating usernames that are vulgar, offensive, or obscene.

3. Creating usernames of other people with the intent to impersonate that person.

4. Creating avatars that are vulgar, offensive, or obscene.

5. Creating avatars of other people with the intent to impersonate that person. 6. Using another User’s account without their prior express permission.

StadiumQuest reserves the right to refuse the registration of an account, delete an account, cancel a username of an account or transfer an account to another username for any reason.

4. User Feedback and Idea Submission

StadiumQuest collects and stores feedback from its Users. StadiumQuest is very appreciative of its users feedback and we request that all comments be sent to [email protected]. Any feedback provided by users to StadiumQuest or any of its employees shall be deemed to be non-confidential. As such, StadiumQuest shall be entitled to the unrestricted use of the gathered feedback for any purpose it deems suitable, commercially, or otherwise, without compensation or attribution to the user who submitted the feedback.

5.Intellectual Property Rights

For the purposes of these Terms of Use, there are two forms of content, “User(s) Content” and “Other Content”. User Content is created and posted by the User and typically consists of, but is not limited to text, images, videos, audio clips, location information, comments, graphics, and interactive widgets provided through the Service. All User Content publicly or privately posted is the sole intellectual property of the User that posts it and StadiumQuest cannot verify or guarantee the authenticity of the Users Content. Therefore, StadiumQuest will not be liable for errors in User Content and cannot guarantee the identity of any other User with whom you may interact while using the Service or communicating through the Platform. As such, Users must acknowledge that all Content accessed on the Platform is used at their own risk and they are responsible and liable for any damages or losses that occur resulting from misinformation.

The User retains the intellectual property relating to the User Content that they post and make available through the Service. To post and participate on the Platform, you are authorizing StadiumQuest a free and unlimited license to reproduce, redistribute, modify, adapt, display, and otherwise use all or part of the User Content within the limits of the selected privacy settings of your account. If you set certain User Content to be publicly available, StadiumQuest will use that content for our business activities and to engage with other Users. Marketing, gameplay, rewards, platform improvement and soliciting current and future users will be the primary uses of the User Content with the goal of making the Platform and Services more engaging and a better overall experience. At the same time, you will be granting other Users you have authorized to access your User Content, the same license and benefits listed above.

All Other Content and materials on this Platform and associated apps provided by StadiumQuest and/or its partners are protected by intellectual property rights. These include but are not limited to text, images, videos, audio clips, location information, comments, data, software, scripts, widgets, graphics, data, data bases and code. These rights include copyrights, trademarks, tradename rights, patent, and design rights. All Users shall maintain copyright notices and restrictions when accessing Other Content through the Platform and Service. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content or materials on this Platform without our prior written permission.

At any time, you can terminate your account. After the deletion of your account the User Content will be removed from the Service. However, any removed content may persist with other Users who previously accessed and downloaded your User Content and in mirrored backup copies for a reasonable period following account deletion.

6. User Conduct

You agree to use this Platform in a lawful and appropriate manner such that you do not violate these Terms of Use. You agree not to use this Platform for any of the following purposes:

  • To violate any law or regulation.
  • To infringe on any patent, trademark, copyright, or trade secret.
  • To harm or threaten to harm any person or entity.
  • To spam, harass, or abuse any person or entity.
  • To post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • To post or transmit any content that infringes the intellectual property rights of any third party.
  • To generate unsolicited advertising, junk, or bulk email (“spamming”).
  • To distribute software viruses, worms, or any other computer code that damages or disables the Service or illegally obtains unauthorized access to other User accounts, StadiumQuest databases or third party information.

7. Disclaimer of Warranties

THIS PLATFORM, SERVICES, AND APPS ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ALSO DISCLAIM ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

8. Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THIS APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to indemnify and hold us harmless from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of this Platform, Services or associated apps.

10. Governing Law

These Terms of Use will be governed by and construed in accordance with the laws of the State of South Dakota, without regard to its conflict of law’s provisions.

11.Entire Agreement

These Terms of Use constitute the entire agreement between you and us regarding the use of this Platform, Services, and associated apps. These Terms of Use supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
